Acceptance of Terms
Sit Happens Dog Training (hereinafter 'Trainer') agrees to provide services to you (hereinafter ‘Client’) subject to the following Terms of Service (“this Agreement”).
The services we agree to provide are personal to you and non-transferable without our express written consent. When using our services, you will also be bound by any guidelines or rules applicable to such services, which may be posted on our website as at the date you use our Service. All such guidelines or rules are hereby incorporated by reference into this Agreement. We may also offer other services that are governed by different Terms of Service. Sit Happens Dog Training reserves the right to change these terms & conditions at any time. You acknowledge and confirm that that you are of legal age to form a binding contract. On the basis of mutual understanding and due consideration, the Parties agree to the following:

General Provisions
The purpose of this agreement is provision of the services described herein pertaining to the Client’s dog (hereinafter ‘Dog’). Trainer undertakes to provide the services in diligent and professional manner, while the Client agrees act in accordance with the instructions provided by the Trainer and to pay the fee for services rendered by the Trainer.

Services
Trainer undertakes to provide private lessons / Walk and Training sessions for Dog and Client (hereinafter ‘Program’). The Program consists of a prior arranged number of lessons each lesson lasting for up to 1 hour. Extra lessons may be requested by the owner by booking through the Trainer’s booking system which would then also be covered by this Training Services Agreement. The lessons will take place at Client’s home or other appropriate place pursuant to the prior agreement between the Parties. The purpose of the training is to adjust the behaviour of the Dog and to teach the Client how to train and work with the Dog. Client hereby agrees that no training is perfect and that effects of the training can be affected by various factors. Trainer will take all appropriate measures to achieve training and behaviour goals but makes no guarantees as to the results. Client further agrees to take all necessary steps to aid the Trainer and to follow on any instruction or advice provided by the Trainer, especially to work with Dog daily and to constantly reinforce the training. Client further acknowledges that Dog may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.

Trainer will advise the Client on the equipment that is necessary for them to acquire. Client agrees to use the equipment in accordance with the instructions provided by the Trainer.

Trainer may take photos and videos of the Dog for use in any media and advertising of the Sit Happens Dog Training and their affiliates. Trainer may use such photos and video on any platform including their website, YouTube, Facebook, Instagram and other social media.

Service Fees
​Client agrees to pay to the Trainer the agreed amount listed on the booking system. First instalment is due before the first lesson. Trainer may deny training if the service fee is not paid before the lesson. The Client may reschedule a training session of the Program with at least 24-hour notice. If the Client cancels within 24 hours of the lesson, but not immediately before the lesson, the Client is obligated to pay ½ of the Service fee. No refund will be provided after the lesson commences or is unable to commence because of the Client regardless of the number of lessons provided. Should you terminate our Services due to a change of mind, you will not be entitled to a refund of any fees paid to us. In the event you fail to attend a Training session at the time and place booked, your payment will be forfeited.

People under 18
Children under 14 years old are not allowed to handle dogs during obedience or puppy classes because of rules set by our insurance company. This rule also means that kids cannot bring dogs into the puppy school or onto the grounds for obedience classes, both before and after class. The safety of everyone is very important, and these restrictions help keep kids and dogs safe while participating in the classes. We appreciate your understanding and cooperation with these rules. When you bring children to training, it's important to take care of them and watch over them closely. Make sure they do not disrupt the training sessions too much. Always check with the dog’s handler before letting your child approach any dog. Some dogs may not be used to kids and might feel unsure about their attention.
Liability
Trainer is not liable for any damage or injury caused by Dog, during or after the term of this agreement. The Client agrees to pay for all resulting losses or damages, and to hold harmless and indemnify the Trainer, Trainer’s agents, employees and affiliates, from any resulting claims, lawsuits, costs and expenses, including legal fees. If during or after the term this agreement the Dog is injured or harmed, the Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses. Trainer is not liable for any damage or injury caused by the equipment during or after the training. Client is responsible for destroying or damaging of the equipment provided by Trainer in all cases where such damage cannot be credited to equipment’s regular wear and tear.

Term of the Agreement
This agreement is valid until terminated. This agreement is automatically terminated when the lessons are completed. This agreement may be terminated in the sole discretion of the Trainer if the Dog is aggressive, dangerous, or otherwise deemed unsuitable for training, or if the Client breaches any part of this agreement.

Final Provisions
In case of any dispute the Parties agree to mediate and settle through negotiations and mutual understanding.

This Contract for Training Services supersedes all other agreements, written or oral, previously made between Client and Trainer.
